The rules of the road.
Last updated May 14, 2026
By using Kruger·Dunning, you agree to these terms. If you don’t agree, please don’t use the site. We tried to make this readable. Nothing here is legal advice; if you need that, talk to a lawyer.
What this service is
Kruger·Dunning is a bracketology platform for college basketball. You can build a season-long ranking, project a 76-team field, make daily picks against historical bubble teams, play a weekly confidence pool against the spread, and compare resumes blind. Your account is free. We may add paid features later; existing free features will stay free.
Your account
To create an account you must be at least 13 years old. One account per person. You are responsible for keeping your sign-in method secure (your Google account or your email inbox if you use magic links).
Your public handle is up to you, within reason. We reserve the right to reclaim handles that impersonate real people, organizations, or trademarks; that are deliberately offensive; or that are clearly squatting on a recognizable identity.
What you can’t do
- Impersonate someone else, including known bracketologists or public figures
- Scrape, crawl, or otherwise bulk-extract data from the site without our written permission
- Use the service for commercial purposes (reselling our data, embedding our content in a paid product, etc.) without our written permission
- Attempt to reverse-engineer, attack, or otherwise probe our infrastructure for vulnerabilities. If you find a security issue, email security@krugerdunning.com and we will work with you
- Spam other users or use the platform to harass anyone
- Use automated tools to make picks or game leaderboards
We may suspend or terminate accounts that violate any of the above, or that cause meaningful harm to other users or the service.
Your content
Picks, handles, notes (when the bracketologist surface ships), and any other content you create on the site stays yours. By posting it, you grant us a non-exclusive license to display it within the service and on related share cards, social previews, and emails. If you delete your account, we stop displaying your content within 30 days, though aggregated, anonymized stats may persist.
Our content
The Kruger·Dunning name, the K·D monogram, the brand colors and typography, and the original site copy are ours. The bracketology data (KenPom, Bart Torvik, NCAA NET, The Odds API spreads, and historical tournament results) belongs to the respective sources; we surface it under fair-use or licensed terms. Don’t republish our content as if it were yours.
No financial advice. No prizes.
Nothing on this site is gambling advice, investment advice, or a recommendation to wager money. Spreads shown in The Seven are from public sources and are illustrative; outcomes here have no monetary value. If we ever introduce contests with prizes, those contests will have their own rules and you’ll see them before entering.
The service is provided “as is”
We work hard to keep the site accurate and available, but we don’t guarantee uptime, accuracy of third-party data, or that the site will be free of bugs. You use the site at your own discretion. We disclaim all warranties to the maximum extent allowed by law.
Limitation of liability
To the maximum extent allowed by law, Kruger·Dunning is not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any direct damages will not exceed the greater of $100 or the amount you paid us in the 12 months before the event giving rise to the claim.
Changes to the service
We’ll add features, retire features, and change the design over time. Material changes that affect existing functionality will be announced on the site or via email when reasonable.
Changes to these terms
If we update these terms, we’ll change the “Last updated” date at the top. Continued use after a change constitutes acceptance. For material changes (rights, liability, or how we use data), we’ll send an email to account holders.
Governing law
These terms are governed by the laws of the United States. Any disputes will be resolved in the state and federal courts located in the operator’s state of residence.
